Defendant, George M. Huntley, pled guilty to a charge of sodomy in the first degree, a Class A felony. ORS 163.405. The victim of the crime was defendants 11-year-old niece. At the time of this offense, defendant was on temporary leave from the Oregon State Penitentiary where he was serving consecutive 20-year sentences stemming from his conviction in March 1978 for sodomy in the first degree and rape in the first degree. In both prior offenses defendant threatened the victims with a weapon.
